1. About These Terms

These Website Terms of Use govern your access to and use of the BERGVENTO website.

BERGVENTO is currently an independent pre-launch project operated by Alberto Maffezzoni. It is not currently operated by a separate incorporated company.

By accessing or using the website, you agree to comply with these Terms. If you do not agree with them, you should not use the website.

2. Current Purpose of the Website

The website is currently used to:

• present the BERGVENTO project and brand;

• provide information about its development;

• display concepts, images and information concerning products that may be offered in the future;

• allow visitors to subscribe to the BERGVENTO newsletter;

• allow visitors to contact us.

Products are not currently offered for sale through the website.

The website does not currently process orders, payments, customer accounts, deliveries, returns or exchanges.

Nothing displayed on the website constitutes a binding offer to sell a product or service.

If online sales are introduced in the future, separate or updated terms of sale, shipping information, withdrawal information, warranty information and refund policies will be made available before purchases can be completed.

3. Website Information

We make reasonable efforts to ensure that information published on the website is accurate and current.

However, BERGVENTO is a project under development. Product concepts, specifications, designs, materials, colors, dimensions, features, expected launch dates and other information may be modified or withdrawn before commercial launch.

Images, renders, prototypes and descriptions may represent products under development and may differ from any final product that may later become available.

We do not guarantee that any product displayed or described on the website will ultimately be manufactured or offered for sale.

4. Newsletter

Visitors may voluntarily subscribe to the BERGVENTO newsletter to receive project news, development updates, launch announcements and related communications.

Newsletter subscriptions are managed in accordance with our Privacy Policy.

You may unsubscribe at any time by using the unsubscribe link included in each newsletter or by contacting us at bergventowatches@gmail.com.

Subscribing to the newsletter does not create an obligation to purchase any future product and does not guarantee access to, reservation of or availability of any product.

5. Permitted Use

You may access and use the website for lawful, personal and non-commercial purposes.

You must not:

• use the website in violation of applicable law;

• attempt to gain unauthorized access to the website or its systems;

• interfere with the operation, availability or security of the website;

The website is hosted using Shopify, which provides the technical infrastructure used to operate and display the website.

Shopify does not operate the BERGVENTO project and is not responsible for BERGVENTO’s content, communications or future products.

The website may also contain links to third-party websites or services. These links are provided for convenience or informational purposes.

We do not control third-party websites and are not responsible for their availability, content, security or privacy practices. You should review the applicable terms and privacy notices before using third-party services.

8. Website Availability

We may modify, suspend or discontinue any part of the website where reasonably necessary, including for maintenance, security, technical development or changes to the BERGVENTO project.

We do not guarantee that the website will always be available, uninterrupted or free from technical errors.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

The collection and processing of personal information through the website are described in our Privacy Policy.

The Privacy Policy should be read together with these Terms.

Where Shopify processes personal information in connection with the website, additional information may be available in the Shopify Consumer Privacy Policy.

The website and newsletter are not intended for children under the age of 16.

If you are under 16, you should not submit personal information through the website or subscribe to the newsletter.

We may update these Terms to reflect changes to the website, the BERGVENTO project, applicable law or the services used to operate the website.

These Terms are governed by Austrian law, excluding its conflict-of-law rules.
